Contract Checklist for
Purchasing Property in Spain
Who are you dealing with? Is he/she
an agent, the owner, the developer. How does he/she
have the right to sell you the property and to take
your money?
If the seller is not the registered
owner of the house does he/she have legally authorised
power of attorney. Ask to see it.
Are you going to buy the property
in your name or do you want it in the name of yourself
and your wife/husband/spouse/someone else or the name
of a company? You need to make this clear at this
stage as although you can change your mind before
completion it may complicate matters and you may not
be able to register the property as you would like.
What capacity do the parties enter
into the contract?
Does the document identify the property
accurately? Is it fully built or under construction?
If the latter ask the seller for a Performance Bond
which will guarantee the return to you of any money
paid to him.
